, hereinafter referred to as the provider, the contract is concluded.

Subject of the contract
This contract regulates the sale of new and used goods from the vehicle trailer / car / truck sector via the provider's online shop. 
For the details of the respective offer, reference is made to the product description on the offer page.

Conclusion of contract
The contract is concluded in electronic business transactions via the shop system or other means of remote communication such as telephone and email. The 
The offers presented represent a non-binding invitation to submit an offer through the customer order, which the provider can then accept. The order process for 
Conclusion of the contract comprises the following steps in the shop system:
Selection of the offer in the desired specification (size, color, number)
Placing the offer in the shopping cart
Press the button 'order'
Enter the billing and delivery address
Selection of the payment method
Review and processing of the order and all entries
Press the button 'order for a fee'
Confirmation email that the order has been received
In addition to the shop system, orders can also be placed via remote communication (telephone / e-mail), which means that the order process for the conclusion of the contract is as follows

The contract is concluded when the order confirmation is sent.
The delivered goods remain the property of the provider until they have been paid for in full.

Reservations
The provider reserves the right to provide a service that is equivalent in quality and price. The service shown in the shop is exemplary and not the individual,  contractual performance. The provider reserves the right not to provide the promised service in the event that the service is not available.

Prices, shipping costs, return costs
All prices are final prices and include the statutory sales tax. In addition to the final prices, there are additional costs, depending on the type of shipping, which are incurred before the order is sent  are displayed. If there is a right of withdrawal and if this is used, the customer bears the costs of the return.

Terms of payment
The customer only has the following options for payment: advance transfer, payment service provider (PayPal), cash on collection, credit card. Other payment methods  are not offered and are rejected.
After receipt of the invoice, which contains all information for the transfer and is sent by e-mail, the invoice amount is to be sent in advance to the account specified there  transferred. When using an escrow service / payment service provider, this enables the provider and customer to process the payment among each other. The  Trustee service / payment service provider transfers the customer's payment to the provider. Further information can be found on the website of the respective trustee service /  Payment service provider.  The invoice amount can also be paid in cash after deducting the shipping costs in the business premises of the provider during normal office hours. When paying by credit card, the customer must be the cardholder. The credit card will be charged after the goods have been dispatched. The customer is obliged to pay or transfer the amount shown to the account specified on the invoice within 7 days of receipt of the invoice. Payment is due from the invoice date without deduction. After expiry of the payment period, which is thus determined by the calendar, the customer is in default even without a reminder. A right of retention by the customer,  which is not based on the same contractual relationship is excluded. Offsetting against customer claims is excluded unless these are undisputed  or legally established. There is also the possibility of financing on request.

delivery terms
The goods will be sent immediately after receipt of payment has been confirmed. The dispatch takes place on average after 60 days at the latest. The entrepreneur undertakes to deliver  on the 60th day after receipt of order. The standard delivery time is 60 days, unless otherwise stated in the item description. The provider either dispatches the order  own warehouse as soon as the entire order is in stock there or the order will be sent by the manufacturer as soon as the entire order is in stock there. The customer gets over  Immediately informed of delays.

Guarantee
If the customer is an entrepreneur, the warranty period for new goods is limited to one year. The provider is granted that, in the event of a supplementary performance, he himself between  Repair or new delivery can choose if the goods are new and the customer is an entrepreneur. If the customer is an entrepreneur, the  Warranty excluded. This does not apply to claims for damages by the customer due to injury to life, limb, health or material damage  Contractual obligations which must necessarily be fulfilled in order to achieve the contractual objective. This also does not apply to claims for damages after grossly negligent or  intentional breach of duty by the provider or his legal representative or vicarious agent. Otherwise, the statutory provisions apply.

Contract drafting
If the customer is an entrepreneur, the risk of accidental loss and / or accidental deterioration of the goods goes with the handover, in the case of dispatch with the delivery 
of the goods to the selected service provider for this purpose on the customer. The contract text is saved by the provider. The customer has no option directly on the  to access the stored text of the contract.

XIII. Place of performance, contract language, place of jurisdiction and changes to the terms and conditions

1. For all legal disputes arising from the contractual relationships between the parties, German law applies to the rest of the time, excluding the UN Sales Convention (CISG). Depending on the legal value in dispute, the Augsburg District Court or the Augsburg Regional Court is agreed as the place of jurisdiction and has jurisdiction.

2. In addition, Oberkrämer is expressly the place of performance for all deliveries and services as well as the execution of any remedial action.

3. The German language is the recognized official language of the EU, both for the interpretation of texts and for the contract language itself.

4. The seller is entitled to continuously make editorial changes in the text of the terms and conditions. The buyer waives any reference information in this regard.

 

In the event of major changes to the text, the seller will inform the buyer before the amended terms and conditions come into force.
